Funerals Created To Your Personal Wishes

What Is A Probate?

When a loved one passes away there is a lot to think about.

On top of handling funeral arrangements and coming to terms with your own grief. Having to navigate the tricky and complex world of probate can be overwhelming. But what is probate?

Probate is a term that refers to the legal and financial processes that deal with the money, assets and property of a person who has passed away.

At Larvin & Clegg, as part of our role as experienced and compassionate funeral directors, we can put you in touch with probate experts who can handle the process on your behalf, allowing you the time and space you need at this difficult time.

When Is Probate Needed?

People commonly wonder when probate is needed, and it’s typically required when the person who has died owned property or had significant assets in their sole name.

Alongside our excellent funeral services, we also believe it’s important to take steps to ensure that your estate is well-managed and in line with your personal wishes. Passing away with your affairs not in order can often lead to family conflicts, as well as costing your beneficiaries a lot of money. To assist you further, we can help you plan ahead for the future ensuring that your family is in the best possible situation legally and financially. People don’t want to think about the difficulties of later life and unfortunately, it’s a subject that tends to get ignored.

Working alongside specialist colleagues we are able to assist with:

  • Probate
  • Property Trusts
  • Inheritance Tax Planning
  • Powers of Attorney
  • Care Home Fee Planning

Banks and other financial institutions may ask for a grant of probate. No matter the circumstances, Larvin & Clegg can take this burden off your shoulders.

How Long Does Probate Take?

The timeframe for probate can vary, but usually, it will take around 9-12 months for the process to be completed.

Sometimes, the timeline can be complicated if a property is being sold, tax affairs need to be settled or there are complex inheritance issues that need to be resolved.

No matter what your probate situation is, we’re here to help.

Probate services are complex and require good legal advice. You could use your own local solicitor, but you are going to spend a significant amount of money and time in the process. Our colleagues at Goddard Dunbar are specialists in probate and offer the services for a significantly lower fixed fee.

At Larvin & Clegg, we understand just how difficult it can be when a loved one passes away. To find out more about our bespoke funeral services in Congleton, Sandbach, and Crewe, or for probate support, get in touch with our team today.
